Terms and Conditions of Sale

  • All prices shown exclude VAT-which will be charged at the current rate.
  • All products carry a minimum 12 month guarantee.
  • Noticeboard Company Cumbria Ltd reserves the right to alter the specification or design of a product without notice. Noticeboard Company Cumbria Ltd claim their right as publishers to the copyright of this website and therefore cannot be replicated without their written consent.
  • Please read these terms and conditions carefully, they contain important information about your rights and obligations as a customer of Noticeboard Company Cumbria Ltd will be hereinafter referred to as ‘Noticeboards Online’ or ‘Noticeboard Company Cumbria Ltd’ or ‘we ‘or ‘us’.

Introduction

Noticeboards Online operates from 9 Garden St, Kendal, Cumbria, LA9 7EB. When ordering from Noticeboards Online you agree to be legally bound by these terms and conditions as they may be modified, and the modifications posted on our website from time to time. Without prejudice to the above, you agree to be bound by the terms and conditions of use herein.

How to Order

You can order by fax, email, website,and letter. Verbal orders are accepted and considered binding. Further information is available upon request.

Payment Terms

  • You must pay by credit or debit card at the time of order, unless you have contacted the Directors of Noticeboards Online to arrange an account or any alternative method of payment or payments such as cheque or BACS payment.
  • All Trade Accounts are due strictly 30 days from the end of the month.
  • The price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure.

Delivery

All prices shown do not include carriage charges. We reserve the right to apply carriage in exceptional circumstances outside the aforementioned criteria. Large orders may be sent on a palletised delivery which can take up to 3 days. In the event of a palletised delivery, we do not recommend a residential delivery address due to the sheer size and weight of the order.

  • Our website is a place for you to select and order marketing support products, hereinafter called the ‘Products’. Our website all the products in detail.
  • Please note that the contents of our website are aimed at users aged 18 and above, and you must be over 18 years to purchase the Products, using the payment methods displayed on our website.

Buying Products on our Website

  • To order a product you will need to follow the ordering procedures set out on our order page. Details of our prices for the Products and the procedures for payment and delivery are displayed on our website.
  • Any times or dates stated for delivery are estimates only. Noticeboards Online will make all reasonable effort to deliver goods within the specified period, but does not accept liability for any failure or liability for additional costs due to the aforementioned failure to deliver within that time.

  • Noticeboards Online is entitled to refuse any order placed by you. If you order on the website you will receive and initial confirmatory email acknowledging receipt of your order. If your order is accepted, we will confirm acceptance to you by email, hereinafter called ‘Confirmation’ to the email address you have given on ordering. This order will then be fulfilled within 20 working days of the confirmation, or any other period specified on a quotation.
  • We brand our products with our company details for the purpose of the identification of our own products at ‘any point in time’ from those of our competitors. This safeguards both Noticeboards Online and you, our customer, when insufficient longevity may be an issue. Our branding will be in place on every product we, at our discretion, decide to brand from time to time. If you require our branding not to be in place on the product you intend to purchase, you must inform us in writing agreeing to accept an unbranded product and waiving your right to challenge Noticeboards Online at any future date in relation to the aforementioned insufficient longevity. Your instruction for Noticeboards Online to remove all branding will be accepted in any of the following forms: Email, Fax or Letter.
  • You undertake that all details you provide to us for the purpose of purchasing goods or services which may be offered by us on our website will be correct, that the credit or debit card, or any electronic cash, which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any goods or services. We reserve the right to obtain validation of your credit or debit card details before providing you with any goods or services.

Returns

  • As most items are made to order, we will only accept products back for refund or exchange if they are ‘Mis-described’ ‘Faulty’ or ‘Damaged’ on delivery ( if notified within 24 hours of the delivery time, by telephone, fax or email). However, we may decide to restock the product as a goodwill gesture, in which case there will be a re-stocking fee. Note: this does not apply to personalised or bespoke products, these are non-returnable unless mis-described, faulty or damaged.
  • If the product is damaged in any way or has become broken in transit, the product must be signed for as ‘damaged’ with the carrier and this must be notified to our sales team by email- info@noticeboard.company or telephone 01539 628309 within 24 hours of receipt otherwise no liability will be accepted by Noticeboards Online, and your goods will not be returnable and you will not be refunded. In the case of you being an account customer, you will remain solely responsible to settle your account within your agreed terms and conditions.

  • If you have any complaints, you should direct them to us via email to info@noticeboard.company or by post to Noticeboard Company Cumbria Ltd, 9 Garden St, Kendal, Cumbria, LA9 7EB. Nothing in the Returns Policy affects your statutory rights under any contract you may have with us.

Delay In Delivery

Any time or date for delivery given by the Seller to the Buyer is the Seller’s estimate of the date on which the goods will be delivered to the buyer, and the seller will make every reasonable endeavour to meet such delivery date, but time shall not in any event be of the essence with regard to delivery. If no dates are so specified, delivery will be within a reasonable time. The seller shall not be liable (in contract, delict, tort or otherwise howsoever) in respect of any liability, loss, expense, claim or damage incurred by the buyer arising from any reasonable delay in delivery of the goods or any part thereof or any delay due to circumstances beyond the seller’s control and in no event shall the seller be so liable for any special, indirect, consequential damage or economic loss including, without prejudice to the foregoing generality, loss of profit, arising from any delay in delivery, howsoever caused.

Delay in Delivery Caused by the Buyer: Where a Special Delivery has been arranged and is postponed by the Buyer at the time of despatch or at the point of delivery , the Buyer will be liable for all costs incurred by the Seller for the postponement and the re-delivery.

Instalment Delivery: The Seller shall be entitled to deliver the Goods by instalments and in such case each instalment shall constitute a separate contract and any failure in delivery of any one or more instalments shall not entitle the Buyer to repudiate the Contract for the supply of a series of instalments as a whole or to cancel any subsequent instalment. In times of shortage of availability of the Goods, the Seller shall be entitled to allocate supplies as it sees fit without being in breach of the Contract or incurring liability hereunder to the Buyer.

Exclusion of Late Delivery Rejection: The Buyer shall not be entitled to reject the Goods or part thereof by reason only of late delivery.

Cancellation Of Order

We consider a purchase order, website order, or email confirming an order as a firm sale. If you wish to cancel your order please contact us immediately. In the event we have already proceeded with production of your order it may be too late to cancel. If it is possible to cancel your order then a charge of £75.00 will be made to cover administration costs. In addition, all costs incurred for work already carried out (including design and artwork) up until the date of the agreed cancellation will also be charged for. Liability

  • We promise that for any Product you purchase:
  • The Product will correspond with the description we have given to you; and the Product will be of satisfactory quality for the money you pay.
  • We exclude all other express or implied items, conditions, warranties, representations or endorsements whatsoever with regard to the Products.
  • We will do our best to ensure that all materials and information published are accurate, but please note that all materials and information are provided on an ‘as is’ basis.
  • In relation to the purchase of Products, we accept no liability for any indirect or consequential loss or damage, or any loss of data, profit, revenue or business ( whether direct or indirect), however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of, or in connection with, the viewing, use or performance of our website or its contents other than as a direct result of purchasing Products, we accept no liability for this loss or damage ( except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of Noticeboards Online or our servants, agents or any other person.
  • If we are liable to you for any reason, our liability will be limited to the amount paid by you for the Product concerned. This limit does not apply to any liability we may have for death or personal injury resulting from our negligence.
  • You agree not to modify in any way the Products supplied. Any such modification may invalidate the manufacturers warranty.

Privacy Policy

Your privacy is important to you and equally important to us. You will supply Personal Information to us when you:

  • Process and fulfill orders.
  • Notify you of your order status.

Your Personal Information may also be disclosed if we need to obtain professional advice or occasionally to credit reference agencies or fraud prevention registers.
  • By providing us with your Personal Information, you consent to us ( and where relevant our affiliates and trusted partners) using (including collecting, storing and processing) the Personal Information you provide to Noticeboard Company Cumbria Ltd as set out in this Privacy Policy. We will of course inform you of any changes to our policy and you will have the opportunity to opt out of those changes, which affect you. Noticeboard Company Cumbria Ltd follows strict security procedures to ensure proper storage and careful disclosure of information in order that nothing happens to your Personal Information. General

  • We may assign novate or sub-contract any or all of our rights and obligations under these terms and conditions at any time.
  • We may alter these terms and conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the terms and conditions regularly.
  • These terms and conditions together with any order form and payment method instructions, if any, are the whole agreement between you and Noticeboard Company Cumbria Ltd. You acknowledge that you have not yet entered into this agreement in reliance upon any warranty or representation made by Noticeboard Company Cumbria Ltd or any other person and you waive any rights to damages/rescission you may have for misrepresentation (other than a fraudulent mispreresentation) that is not contained in the terms and conditions, order form and payment method instructions.
  • If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.
  • These terms and conditions are governed by English law and you submit to the exclusive jurisdiction of the English courts.
  • Neither you nor Noticeboard Company Cumbria Ltd will be held liable for any failure to perform any obligation to the other due to causes beyond your or Noticeboard Company Cumbria Ltd respective reasonable control.
  • Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right of remedy.

These terms and conditions replace all other terms and conditions previously applicable to the use of our website and/or sale of the Products.

Extended Guarantees

Return To Base Guarantee

Many of our premium products are covered by a 5 year guarantee as standard. This covers defective parts and/or labour with the exception of the pinboard core and fabric coverings*, and is based on normal operating conditions within the UK and Republic of Ireland.

Powder Coated finishes are applied to the standards of the powder coating suppliers. Colour fastness and corrosion resistance is dependent on the location and atmospheric conditions. Therefore our guarantee is limited to corrosion resistance only in line with our powder coating suppliers’ specifications, with the following provisions:

1) Products with Powder Coated finishes that are installed within 1 mile of a coastal location** must also have the extra coastal intermediate primer protection applied to the external finish.
2) Products with Satin Silver, Polished Gold or Polished Silver finishes that are installed within 1
mile of the coast must also have the additional clear Powder Coating applied to the external finish.

The guarantee is offered on the basis that any faulty product is returned to the factory to assess and/or remedy, with prior written agreement of the manufacturer. The cost of returning the product to the manufacturer is not included in the guarantee, and the installation of the repaired noticeboard is not covered. Photographic evidence may be required before the product is returned. The 5 year guarantee does not cover consequential losses or expenses. If the product has been modified or tampered with other than as expressed in the instructions, or notified and agreed by the manufacturer, the manufacturer reserves the right to void the guarantee.

In order to uphold your guarantee, please ensure the products are:
1) Installed as directed in the instructions we provide
2) Well maintained using guidance information stated on the instructions
3) Cleaned regularly using guidance information stated on the instructions

Frequency of cleaning will depend on local conditions, but the minimum recommendation is at least twice a year. In most cases regular cleaning will also help your product last beyond the 5 year guarantee.

* Please note that Coloured Magnetic Inserts offer a much greater durability than fabric coloured Pinboards, especially in their colour fastness. ** As well as highly industrial locations or any other locations with high levels of Sulphur Dioxide in the atmosphere.

5 Year Guarantee

Some of our premium products now feature a 10 year guarantee. This covers the quality of workmanship and materials used.

Our guarantee is that these products are free from defects in material and in our workmanship. Our guarantee is limited to the labour and material costs of repair within 10 years of the date of despatch and excludes the cost of returning the product to the manufacturer. Noticeboard Company Cumbria Ltd is not liable for the cost of installing the repaired product. There are several exceptions to this guarantee:

1) Damage caused by improper installation.
2) Damage caused as a result of lack of maintenance as described in our instructions.
3) Product modification or vandalism.
4) Cosmetic damage including colour fading.
5) Reasonable wear & tear

Condensation
Condensation is a natural phenomenon which occurs when a constant air volume is exposed to a cold surface and there is a large temperature difference between the inside and outside of a surface. The more water/air tight, the larger the internal volume and the colder the outside temperature the more condensation will be present in an outdoor showcase. Whenever a notice board is opened moist air can flow into the volume which will percolate when the outside temperature drops. This phenomenon becomes more common as air temperatures drop and surface temperdoor drop to near or below 0 degrees Celsius. You will notice that this happens even inside cars and the only way to prevent/clear condensation is by heating the offending surface. We would recommend that should a customer find this to be an issue that they open their showcase and wipe the surface down with a suitable cloth.
